Benefits of the Trust & Company Structure


From an asset protection perspective, a company is a separate legal entity or ‘person’ that provides limited liability for shareholders. By using a company, the personal assets of the beneficial owner may not be at risk of claims from creditors in the event that the business is sued by third parties, except perhaps where the business is trading as insolvent or in the case where the individual has attempted to move their assets into an offshore structure after an event occurs which means that their assets are in immediate risk.[/item]


Asset protection trust structures provide protection as there is a separation of the assets held from the assets of the person who has settled the trust. A trust is not a legal entity; the assets of the trust will be held in the name of the Trustee. The Trustee then holds the assets (Trust Fund) (which could be the trading company) in trust for the benefit of the beneficiaries. This creates a legal separation of the assets from the individual.

Why the Isle of Man?

The Isle of Man, with its 1000 year old Parliament (Tynwald), is a self-governing Crown Dependant island situated in the northern Irish Sea. Despite its closeness to the UK it is independent and makes its own laws and all internal administration, fiscal and social policies. It is an established and well respected international finance centre with political and fiscal stability and low taxation.

The Isle of Man is in the “common purse” with the UK for Customs and Excise. The standard rate of VAT is therefore in line with the UK at 20%. The rate of income tax applicable to Isle of Man companies not engaged in banking or local real estate business is 0%.
